1. Seller Identification

2. Service Subject

Through the website, Tatarinov Coach offers pre-structured digital programs (e.g., PDF sheets and video materials) and individual online coaching services for physical and sports training focused on Armwrestling.

3. Purchase and Payment Methods

The purchase of services and digital products occurs through the secure Stripe payment platform. At the time of purchase, in order to process invoicing, the buyer's tax data will be requested. No credit card data is saved on our servers.

4. Exclusion of Right of Withdrawal

Pursuant to art. 59, letter o) of the Consumer Code (Legislative Decree 206/2005), the right of withdrawal is excluded for the provision of digital content via a non-material support if execution has begun with the express agreement of the consumer and with their acceptance that they would lose the right of withdrawal in this case. Therefore, by purchasing and receiving digital programs, the user explicitly waives the right of withdrawal and refunds will not be possible.

For individual online coaching services, the right of withdrawal is excluded to the extent that the service has already been fully performed, or its performance has begun with the consumer's express prior consent, pursuant to art. 59, letter a), of the Consumer Code. Coaching sessions must be rescheduled or cancelled with at least 24 hours' notice; otherwise, they will be considered as delivered.

5. Disclaimer of Liability (Medical Disclaimer)

The programs, training sheets, and advice provided are for informational and sports purposes only. They do not constitute medical or physiotherapy advice. The user assumes full responsibility for their physical fitness to practice sports and releases Tatarinov Sergio from any civil and criminal liability for any injuries, physical damage, or health problems resulting from the execution of the proposed exercises.

6. Intellectual Property

All materials provided, including but not limited to PDFs, videos, training sheets, and texts, are the exclusive intellectual property of Tatarinov Sergio. Reproduction, sharing, distribution, or resale of such materials to third parties is strictly prohibited. In case of violation, the Owner reserves the right to take legal action and immediately suspend access to services.

7. Complaints and Dispute Resolution

Any complaint can be sent by email to tatarinovsergio@gmail.com and will be handled as soon as possible. If you are a consumer residing in the EU, you may also use the European Online Dispute Resolution (ODR) platform, available at https://ec.europa.eu/consumers/odr, to seek an out-of-court settlement of the dispute.

8. Use of Artificial Intelligence

This website does not currently use chatbots or AI-generated content in its interactions with users. Should such tools be introduced in the future, in compliance with Regulation (EU) 2024/1689 (AI Act), clear and visible information will be provided at the point of interaction, informing users that they are interacting with an artificial intelligence system or viewing AI-generated content.

9. Applicable Law and Jurisdiction

These Terms and Conditions are governed by Italian law. For any dispute concerning the validity, interpretation, or execution of this contract, the Court of Rome shall have exclusive jurisdiction, without prejudice to the mandatory protections granted to consumers by their local law, if more favorable.
